1. Purpose
This Acceptable Use Policy explains conduct that is not allowed on Data Dialer. It is part of the Terms of Service. Customers are responsible for their users, lists, campaigns, vendors, and calling practices.
2. Consent and calling authority
You may call only when you have the consent, permission, business relationship, or other lawful basis required for that call. You must keep records sufficient to demonstrate that basis. You may not rely on Data Dialer’s availability, controls, or phone-number tools as proof that a call is lawful.
3. Prohibited conduct
You may not use Data Dialer to:
- Call a person without the consent or other authority required by applicable law.
- Call a number on the National Do Not Call Registry, a state list, or an internal suppression list unless a valid exemption applies and you can document it.
- Use purchased, scraped, harvested, or shared lists in violation of law or without the required permission.
- Place prerecorded, artificial-voice, or automated calls without the consent and disclosures required for that specific call.
- Spoof, falsify, or deceptively manipulate caller identification or origin information.
- Harass, threaten, defraud, impersonate, discriminate, or repeatedly call a person who has asked not to be contacted.
- Hide the caller’s identity, fail to provide required opt-out methods, or interfere with a recipient’s attempt to stop calls.
- Upload malware, probe security, disrupt service, evade limits, or access another customer’s account or data.
- Use the service for any unlawful, deceptive, abusive, or unauthorized purpose.
4. Customer obligations
The customer organization and every insurance agent using Data Dialer must maintain and honor applicable internal and government do-not-call requirements, train authorized users, use accurate caller information, observe permitted calling hours and frequency limits, provide required disclosures, maintain evidence of consent or another lawful basis, and comply with federal, state, local, insurance-industry, and recording-consent rules. You must promptly investigate complaints and cooperate with reasonable compliance inquiries.
5. Enforcement
We may investigate suspected violations and may restrict features, suspend calling, preserve relevant records, or terminate an account. Serious or repeated violations may be reported to providers or authorities when required or appropriate. Enforcement by Data Dialer does not replace the customer’s responsibility for its conduct.
6. Report misuse
To report suspected misuse, email monarchdev@data-dialer.com with the calling number, approximate date and time, and a brief description. Do not include sensitive personal information that is not necessary for the report.
